General Terms of Use for Tripo lpha

Welcome to Tripo Alpha ("we," "our," or "us"), a ride-booking platform operated by ALPHA OMEGA CAR RENTAL - FZCO in the United Arab Emirates ("UAE"). These General Terms of Use ("Terms") constitute a legally binding agreement between you ("User") and us, governing your access to and use of our services through the Tripo Alpha application, website, and related services (collectively, the "Platform").

Definitions

  • Platform : Refers to the Tripo Alpha app, website, and associated services provided by us.
  • User : Any individual or entity accessing or using the Platform, including both riders and drivers.
  • Rider : A User who books and uses transportation services through the Platform.
  • Driver : A licensed individual providing transportation services through the Platform.
  • Services : The ride-booking, payment facilitation, and associated services made available through the Platform.

Eligibility

    To use the Platform, you must:

  • Be at least 18 years old or the age of majority in your jurisdiction.
  • Have the legal capacity to enter into binding agreements.
  • Provide accurate and complete registration information.

    • By using the Platform, you represent and warrant that you meet these eligibility requirements. If you are using the Platform on behalf of an entity, you represent that you have the authority to bind that entity to these Terms.

User Accounts

    Account Creation and Maintenance

    To access the Platform, Users must create an account by providing accurate and up-to-date information. Riders are required to provide their name, phone number, email address, and payment information, while Drivers must provide additional documentation such as:

  • Valid UAE driver's license.
  • To access and use the Services, you agree to: Vehicle registration and proof of insurance.
  • Compliance with UAE transport laws and regulations.

    • Account Security

  • Users are responsible for maintaining the confidentiality of their account credentials. Unauthorized access or use of an account must be reported immediately to tripoapp@gmail.com Tripo Alpha is not liable for any loss or damage resulting from unauthorized account access.

Services and Limitations

    Scope of Services

    Tripo Alpha connects Riders with Drivers for transportation services. The Platform acts as a facilitator and does not operate as a transportation carrier or employ Drivers.

    Service Availability

    The availability of the Platform may vary based on geographic location, demand, technical issues, or legal constraints. We reserve the right to modify or discontinue services without notice.

    No Guarantee

    We strive to provide reliable and timely services but do not guarantee the availability, timeliness, or quality of rides. Riders and Drivers acknowledge that services are subject to external factors beyond our control.

User Obligations

    Accurate Information

    Users must provide and maintain accurate, complete, and up-to-date information on their accounts. Falsifying information may result in account suspension or termination.

    Lawful Use

    Users must comply with all applicable laws and regulations when using the Platform. Prohibited activities include:

  • Using the Platform for illegal or fraudulent purposes.
  • Harassing, threatening, or harming other Users.
  • Interfering with the functionality or security of the Platform.

    • Riders requiring accessibility accommodations or traveling with service animals must inform Drivers in advance. Drivers are required to comply with UAE regulations regarding accessibility and service animals.

    Service Animals and Accessibility

    Riders requiring accessibility accommodations or traveling with service animals must inform Drivers in advance. Drivers are required to comply with UAE regulations regarding accessibility and service animals.

Payment and Fees

    Rider Payments

    Riders agree to pay the fare displayed at the time of booking, which may include base fare, distance traveled, time spent, and additional charges such as tolls or surcharges. All payments must be made electronically via the Platform’s payment processing system.

    Driver Payments

    Drivers are compensated based on completed trips, calculated after deductions for platform service fees. Payments are disbursed regularly through secure payment methods.

    Refunds and Disputes

    Refund requests are evaluated on a case-by-case basis. To initiate a refund or dispute, Users must contact billing@tripoapp.com within 14 days of the transaction.

Driver Obligations

    Drivers are independent contractors responsible for providing safe and reliable transportation services. Obligations include:

  • Maintaining a clean and operational vehicle.
  • Complying with all UAE transport and traffic laws.
  • Providing courteous and professional service.

    • Failure to meet these obligations may result in account suspension or termination.

Limitation of Liability

    To the fullest extent permitted by law:

  • Tripo Alpha is not liable for the actions, omissions, or conduct of Users or third parties.
  • Tripo Alpha provides the Platform "as is" and disclaims all warranties, including merchantability, fitness for a particular purpose, and non-infringement.
  • Tripo Alpha’s total liability is limited to the amount paid by the User for services in the 12 months preceding the claim.

Termination and Suspension

    We reserve the right to terminate or suspend User accounts for violations of these Terms, applicable laws, or misuse of the Platform. Users may also terminate their accounts by contacting tripoapp@gmail.com

Privacy and Data Protection

Dispute Resolution

    Governing Law

    These Terms are governed by the laws of the UAE. Any disputes shall be resolved in the courts of Dubai.

    Arbitration

    Users agree to resolve disputes through binding arbitration in accordance with UAE arbitration laws. Each party is responsible for its own legal fees.

    Modifications to Terms

    TWe may update these Terms to reflect changes in services, laws, or business practices. Users will be notified of significant changes via email or app notifications. Continued use of the Platform constitutes acceptance of the updated Terms.
